Under the Arizona Constitution, the power of the people to create their own laws is equal to that of elected legislators. On April 20, the Arizona Supreme Court will hear oral arguments in a case that seeks to invalidate Prop 208 \u2013 Invest in Ed, which was passed by Arizona voters in the last election\u202fand&nbsp;<a href=\"https:\/\/azcapitoltimes.com\/news\/2021\/02\/09\/court-rejects-bid-to-put-hold-on-surcharge-on-wealthy\/\">upheld by a lower court judge\u202fearlier this year<\/a>. Voters will be watching closely to see if the&nbsp;Supreme&nbsp;Court will respect the people\u2019s constitutional rights.\u202f<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"http:\/\/stand.org\/sites\/default\/files\/styles\/large\/public\/Uncategorized\/SupremeCourt_CapTimes.jpg?itok=DI3InTuv\" alt=\"\"\/><\/figure>\n\n\n\n<p><em>(Photo by AZ Capitol Times)<\/em><\/p>\n\n\n\n<p>This case is important for several reasons. For one, it represents the third time&nbsp;opposition groups have asked&nbsp;the Arizona Supreme Court to&nbsp;end&nbsp;Invest in Ed. The first, in 2018, led\u202fto\u202fthe initiative being\u202fremoved from the 2018 ballot after hundreds of thousands of signatures had been\u202fcollected and&nbsp;submitted. The Supreme Court&nbsp;decided the case&nbsp;on a technicality that left many supporters shell shocked and confused.\u202fThe second, in the summer of 2020, also&nbsp;tried to remove Invest in Ed after hundreds of thousands of signatures were collected and submitted. This time,&nbsp;Invest&nbsp;in Ed was successful and remained on the\u202fNovember 2020\u202fballot as Prop 208. It won with 1.7 million Arizonan&#8217;s voting in favor, and by a larger margin than either President Biden or Senator Kelly.\u202f&nbsp;<\/p>\n\n\n\n<p>The second reason this case is important is that it represents another attempt by Governor&nbsp;Ducey&nbsp;to strong arm\u202fhis allies to undermine the voters. In this case,&nbsp;Governor&nbsp;Ducey&nbsp;filed a brief with&nbsp;the high court\u202f<a href=\"https:\/\/apnews.com\/article\/business-legislature-arizona-doug-ducey-tax-reform-b96c6018e6de9a4aec8ad6d7ee07cba8\">urging it&nbsp;to\u202fsidestep the normal\u202fprocedure<\/a>\u202fand immediately take the case.\u202fCombine this with the atrocious behavior of the House Ways and Means Committee Chair, Shawna&nbsp;Bolick&nbsp;(who is married to&nbsp;Ducey&nbsp;Supreme Court appointee Clint&nbsp;Bolick) when\u202f<a href=\"https:\/\/www.azcentral.com\/story\/news\/politics\/legislature\/2021\/03\/24\/republicans-arizona-capitol-limit-debate-emotions-boil\/6987102002\/\">discussing Prop 208\u202fduring a committee hearing\u202f<\/a>and other\u202f<a href=\"https:\/\/www.azcentral.com\/story\/opinion\/op-ed\/laurieroberts\/2018\/10\/26\/arizona-supreme-court-voted-invest-ed-doug-ducey-predicted\/1776378002\/\">past reports of inappropriate\u202fcommunication<\/a>\u202fbetween the Governor and the Court,&nbsp;it is critical that&nbsp;this Court&nbsp;act&nbsp;impartially&nbsp;and&nbsp;remain independent, rather than surrender to political pressure from&nbsp;the Executive and Legislative branches.\u202f<\/p>\n\n\n\n<p>The third reason this case is important is that the Arizona Supreme Court has the responsibility to protect the will of the voters against efforts by some legislators and special interest groups to undermine the people\u2019s&nbsp;law.\u202f<a href=\"https:\/\/www.yourvalley.net\/stories\/arizona-legislators-back-new-measures-to-restrict-initiatives,216993\">This effort is not\u202fnew,<\/a>\u202fbut\u202fis coming to a head with Prop 208.\u202fThe law that the people passed is clear and constitutional. Yet a small group of&nbsp;political&nbsp;opponents are asking the Court to declare the law unconstitutional as an end-run around the citizen initiative process\u202fsimply because they&nbsp;didn\u2019t&nbsp;like the outcome of an election. Arizonans\u202fvalue their constitutional right to the ballot measure process, and\u202fthey will be watching\u202fclosely to see if the Court\u202fwill\u202frespect that\u202fright.\u202f&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"http:\/\/stand.org\/sites\/default\/files\/styles\/large\/public\/Uncategorized\/IMG_1996-e1550266757435-1024x639%20%281%29.jpg?itok=xsjPwiT-\" alt=\"\"\/><\/figure>\n\n\n\n<p><em>(Photo by AZ Capitol Times)<\/em><\/p>\n\n\n\n<p>The fourth reason this case is important is why we supported Prop 208 to begin with \u2013 its impact on the future of our students and our education system.\u202fProp 208 &#8211; Invest in Ed restores nearly a billion dollars annually in K-12 education funding to solve the teacher shortage crisis, lower class sizes, hire aides and counselors, and expand career and technical education. Even since its passage, voters still believe that additional funding for public education is needed.<a href=\"http:\/\/stand.org\/arizona\/blog\/annual-survey-arizonans-want-school-funds\">\u202f72% of Arizona voters<\/a>\u202fbelieve there is a need for additional funds for Arizona public schools above and beyond what Prop 208 &#8211; Invest in Ed will ultimately provide.\u202fThe\u202fArizona Supreme Court Justices have a chance to leave a legacy of improving the lives of Arizona\u2019s children.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>If\u202fthe opponents of Invest in Ed get their way in court,\u202fit will&nbsp;undermine Prop 208 \u2013 Invest in Ed, and the will of Arizonans who voted for it. We have seen this\u202fbefore\u202f\u2013\u202fpoliticians and special interests helping a handful of the\u202fwealthiest\u202fin Arizona\u202fat the expense of teachers, students, and small businesses.\u202f&nbsp;<\/p>\n\n\n\n<p>We\u2019re&nbsp;so close to adding a much-needed $1 billion annual investment into Arizona schools, and our opponents are getting desperate.
